A. Cancellation Policy

Introduction

Consumers have the right of withdrawal under the following conditions, where “consumer” means any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity:

Right of Withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the last item.

To exercise your right of withdrawal, you must notify us (Fitonit GmbH, Bahnstraße 34, 82131 Stockdorf, Germany, Tel.: +49-8989949091, Email: info@fitonit.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email). You may use the attached sample withdrawal form for this purpose, but its use is not mandatory.

You can also exercise your right of withdrawal online on the website at the following URL: https://fitonit.de/Right of Withdrawal Policy/ exercise. If you use this online feature, you will immediately receive a confirmation of receipt on a durable medium (e.g., via email) containing information about the content of the notice of withdrawal, as well as the date and time of its receipt.

To comply with the cancellation period, it is sufficient for you to send the notice of your intention to exercise your right of cancellation before the cancellation period expires.

Consequences of the Revocation

If you cancel this contract, we must refund all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without delay and no later than fourteen days from the day we receive notice of your cancellation of this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods without delay and, in any event, no later than fourteen days from the date on which you notify us of your cancellation of this contract.

The deadline is met if you ship the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods.

You are only liable for any loss in value of the goods if such loss is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics, and functionality.

Exclusion or Premature Termination of the Right of Withdrawal

The right of withdrawal does not apply to consumers who, at the time the contract is concluded, are not citizens of any Member State of the European Union and whose sole place of residence and shipping address, at the time the contract is concluded, are located outside the European Union.

General Information

1) Please avoid damaging or soiling the merchandise. Please return the merchandise to us in its original packaging, including all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against damage during shipping.
2) Please do not return the goods to us with shipping charges due.
3) Please note that the aforementioned points 1–2 are not prerequisites for the effective exercise of the right of withdrawal.
